Summary
- Merchie builds branded loyalty apps for local businesses (med spas, salons, clinics). Each business can text its own customers marketing offers through Merchie.
- Consent is a single, unchecked checkbox shown at the exact moment the customer enters their mobile number during sign-up. That screen contains one consent and nothing else — no other agreement is bundled with it.
- The SMS Terms & Conditions and Privacy Policy are linked directly under that checkbox, on the opt-in screen itself.
- We do not share or sell mobile numbers or SMS opt-in data to third parties, and we never text customers offers for an unaffiliated third party.
- Reply STOP to opt out at any time; reply HELP for help.
How customers opt in
- A customer downloads their business’s Merchie-powered loyalty app and begins creating an account.
- On the phone number screen, they enter their mobile number. Directly beneath the number field sits a single “Text me deals and offers” checkbox with the full consent disclosure, and beneath that, links to the SMS Terms & Conditions and the Privacy Policy. The box is unchecked by default, and it is the only consent on the screen.
- The customer checks the box, then taps “Send verification code” and confirms ownership of the number with a one-time code texted to it. The button stays disabled until the box is checked, so consent is always an explicit, affirmative act tied to the verified number.
Each opt-in is recorded with a consent audit trail (date, time, and the screen the consent was given on). No marketing texts are sent without it.
A customer who declines at sign-up is never texted marketing. If they want the messages later, the Settings → Notifications → “Text me deals & offers” toggle is the one other place consent can be given — it is off unless the customer turns it on, it shows the same disclosure and the same two policy links, and it is also where consent is withdrawn.
The opt-in screen
Below are real screenshots from a Merchie-powered app of the sign-up screen where the number is collected and consent is given — the same screen before and after the customer ticks the box (each business runs its own branded app, so only the business name changes). It contains one consent: the “Text me deals and offers” checkbox, which is empty until the customer taps it.

As the screen opens. The box is empty and “Send verification code” is greyed out, so sign-up cannot proceed on an untouched box.

After the customer ticks the box. Only then does the button become active, and a one-time code verifies the number the consent was given for.
Consent language (shown at opt-in)
“Text me deals and offers. By checking this box, you agree to receive recurring automated marketing text messages from [Business Name] at the number above. Message frequency varies. Consent is not a condition of any purchase. Message and data rates may apply. Reply STOP to opt out, HELP for help.”
Immediately beneath that disclosure, on the same screen, the customer sees two tappable links: SMS Terms & Conditions and Privacy Policy.

First-party only — no third-party marketing
Merchie is the technology provider. Each message is sent on behalf of the one local business whose own app the customer opted in through, and it promotes only that business’s products, services, and promotions. We do not send marketing for unaffiliated third parties, advertisers, affiliates, lead-generation partners, or data buyers, and we do not sell, rent, or share mobile numbers or SMS opt-in data. A customer who uses two Merchie-powered apps opts in separately in each one; consent never carries across businesses.
Message frequency & rates
Message frequency varies by business and by the promotions they run. Message and data rates may apply. Consent to receive marketing texts is not a condition of any purchase. Carriers are not liable for delayed or undelivered messages.
How to opt out or get help
- Reply STOP (or CANCEL, END, QUIT, UNSUBSCRIBE) to any message to stop all marketing texts.
- Or turn off Settings → Notifications → “Text me deals & offers” in the app.

Privacy
